General Terms and Conditions (AGB) for the Online Examination – DKH Institut GmbH
- Registration 1.1. Participation in the exam is only possible with prior registration. 1.2. You can register for our exam either in person or online. Payment is usually made by bank transfer or in cash at the DKH Institut. 1.3. Your registration for the exam at DKH Institut is binding and requires immediate payment of the fee. 1.4. The exam fee for an exam at DKH Institut is 190 Euros.
- Exam Review 2.1. The exam review is conducted individually under strict supervision by two teachers and may be time-consuming and costly. 2.2. Only one person is allowed in the room during the review. 2.3. No writing instruments (e.g., pens) or devices such as mobile phones or photo-capable devices are allowed. 2.4. The exam review may only take place in the rooms of DKH Institut, subject to availability. 2.5. The price for the exam review is 120 Euros.
- Examination Rules 3.1. Technical Requirements Ensure that you are using a device with a microphone and camera. Test your device in advance and activate the microphone and camera before the oral part of the exam. Recommended browser: Google Chrome. If you are using an Apple device, you can also open the link with Safari. 3.2. Device Check and Technical Errors Check your internet connection and technical equipment before the exam. Technical issues or connection failures may result in the exam being retaken for a fee. 3.3. Avoiding Fraud You must be alone in the room. The presence of another person is considered an attempt at cheating, regardless of the reason. It is prohibited to record, store, or share exam content. Violating this will result in the cancellation of your exam results. Only the registered person may take the exam. If the examiner or DKH Institut has any suspicion of cheating, the exam will be immediately cancelled. This also applies if the suspicion is based on minor irregularities. Read the task carefully and speak freely about the topic (no reading from texts!). Turn off all unnecessary devices. Ensure that you are not disturbed during the exam.
- Cheating 4.1. Cheating Attempts In case of an attempt at cheating, even based on a mere suspicion, the exam will be immediately cancelled, and the participant will not receive a refund. 4.2. Violation of Exam Rules If the exam rules are violated (e.g., use of unauthorized devices, presence of other people in the room, recording or sharing of exam content), DKH Institut is entitled to cancel the exam and annul all results without a refund.
- After the Exam 5.1. The exam results will be evaluated within three weeks. Your certificate will be sent to you by email. If you need a printed certificate, you can contact us by email. You can then collect it at the office or have it sent by post.
- Disclaimer 6.1. Liability for Technical Problems: DKH Institut is not liable for technical issues that are outside the Institute's control, such as connection failures, software or hardware errors on the participant’s or third parties' side, which result in an unsuccessful exam or delays. Participants are responsible for ensuring their devices meet the technical requirements and function properly. DKH Institut is not liable for the consequences of unmet technical requirements. 6.2. Liability for Cheating Attempts: In the case of a cheating attempt, even based on a mere suspicion, the exam will be immediately cancelled, and the participant will not receive a refund. If the exam rules are violated (e.g., use of unauthorized devices, presence of other people in the room, recording or sharing of exam content), DKH Institut is entitled to cancel the exam and annul all results without a refund. 6.3. Liability for Personal Data and Privacy: DKH Institut is committed to protecting all personal data according to the General Data Protection Regulation (GDPR). However, it is not liable for data loss or damage caused by external attacks, communication errors, or software problems. If exam recordings (e.g., videos of the oral exam) are made, the participant will be informed that these recordings will be used solely for exam purposes. Any liability related to the storage or processing of these recordings outside the exam context is expressly excluded. 6.4. Liability for Exam Results: DKH Institut is not liable for the outcome of the exam. Passing or failing the exam depends on the individual performance of the participant and is assessed according to the established criteria. Liability for the exam results is excluded. 6.5. Liability for Property Damage and Injury: DKH Institut is not liable for property damage or injury that occurs during the exam or on the premises of the Institute, unless caused by gross negligence or intentional behavior on the part of DKH Institut. Participants are responsible for the safety of their personal items. The Institute is not liable for the loss or damage of personal items lost or damaged during the visit to the Institute’s premises or during online exams. 6.6. Liability for Force Majeure: DKH Institut is not liable for exam cancellations or course cancellations due to force majeure, such as natural disasters, epidemics, or other unforeseen circumstances beyond the control of the Institute. In such cases, efforts will be made to reschedule the exams at a later date. If the exam cannot take place due to force majeure, there is no right to a refund of the exam fees. Rescheduling is possible in such cases.
- Right of Withdrawal 7.1. You have the right to withdraw from the contract/registration within fourteen days without stating any reason, unless you have given consent for the right of withdrawal to expire early. 7.2. The withdrawal period is fourteen days from the day the contract is concluded (from the day of registration). 7.3. You may withdraw from the contract within 14 calendar days without giving any reason by sending a written notice of cancellation (e.g., letter, email). It is sufficient to send the cancellation within this period (the date of the postmark is decisive). Saturdays, Sundays, and public holidays count as well. 7.4. The written cancellation notice should be sent to:

Email: [email protected] 7.5. You also have the option to declare your cancellation in person at the DKH Institut within the withdrawal period. 7.6. If you withdraw from this contract, we will refund all payments we have received from you without delay and no later than fourteen days after we have received your notice of withdrawal. 7.7. If you requested that services begin during the withdrawal period, you are required to pay an appropriate amount according to our terms and conditions, which corresponds to the proportion of the services already provided up to the point when we were informed of your exercise of the right of withdrawal in relation to the total services agreed upon in the contract. - Notice of Expiry of the Right of Withdrawal 8.1. Your 14-day right of withdrawal expires early in the case of a service contract if DKH Institut has fully provided the service or has begun providing the service after you have given your consent and at the same time confirmed your understanding that you will lose your right of withdrawal.
- Retakes 9.1. If a technical problem occurs or the exam cannot be completed for other reasons, the affected part of the exam may be retaken for a fee of 100 Euros. 9.2. It is also possible to retake the entire exam if required due to problems or other reasons. In this case, the participant must re-register and pay the full exam fee again. 9.3. The decision on whether to retake parts of the exam or the entire exam will be made by the DKH Institut examination board based on the specific circumstances.
- Cancellations 10.1. Cancellations must be made in writing. The cancellation fees are: From ∞ to 30 calendar days before the exam: 0 Euros.
From 30 to 0 calendar days before the exam: 100 Euros.
No refund will be given if the participant does not show up or after the exam has started. 10.2. Refunds will only be made via bank transfer and within 14 working days. 10.3. In the case of an exam interruption or cancellation, no refund of the exam fee is possible. Missed exam days cannot be made up, and no extensions are possible due to this reason. 10.4. In the event of force majeure, natural disasters, or epidemics, and their consequences, no refund of the exam fee is possible. - Rescheduling 11.1. Rescheduling costs: From ∞ to 30 calendar days before the exam: 0 Euros.
From 30 to 0 calendar days before the exam: 100 Euros.
No rescheduling is possible if the participant does not show up or after the exam has started. 11.2. The rescheduling can be postponed for up to 2 months. Rescheduling is allowed only once. 11.3. Proof must always be provided. 11.4. The exam rescheduling to another person is possible. The rescheduling to another person is allowed only for the same exam. Rescheduling to another person costs 100 Euros. 11.5. By rescheduling, the terms and conditions are accepted again. - Exam Procedure 12.1. You have registered for a specific exam date. On the exam day, you will receive a link or can start the exam directly on the website. 12.2. To start the exam, you just need to enter the email address you registered with. Then you can begin the exam. 12.3. The exam link will be sent to you by email on the day of the exam, around 9:00 AM, or you can start the exam directly via the website: https://client.deutsch-kurs-hannover.de/exam/start. 12.4. There is no trial exam or sample test. Once you start the exam, it begins immediately. 12.5. You have until 10:00 PM to start and finish the exam. 12.6. To prepare for the exam procedure, you can watch the following examples of the written and oral exams:
- Online Materials 13.1. The delivery of materials to the customer is done by making them available in the password-protected customer-specific area provided by DKH Institut, and notifying the customer via the email address provided by the customer. 13.2. The customer is obliged to check their email account regularly. DKH Institut is not obligated to make any changes to the documents once they have been uploaded. 13.3. The customer is required to provide a valid email address and ensure that their inbox has sufficient storage capacity for receiving the notification. If the provided email address changes or becomes invalid, the customer must immediately provide an updated email address.
- Consent to Use of Camera and Microphone During Online Exams By participating in this online exam, I consent to the use of my camera and microphone during the exam period. I understand that this is necessary to ensure the integrity of the exam and prevent cheating attempts. 14.1. Access to Camera and Microphone: I allow access to my camera and microphone to enable audio and video recordings during the exam. These recordings will be used solely for monitoring and evaluating my exam performance. 14.2. Data Privacy: I have been informed that all personal data and recordings captured during the exam will be handled in accordance with applicable data protection laws. These data will be stored only as long as necessary for evaluating the exam results and fulfilling legal requirements. 14.3. Right to Withdraw: I understand that I have the right to withdraw my consent at any time. However, I also understand that withdrawing my consent to use the camera and microphone during the online exam may result in my exclusion from the exam. 14.4. Purpose of Data Collection: The recordings are solely for conducting and maintaining the integrity of the online exam. These data will not be used for any other purpose without my explicit consent. 14.5. By participating in this online exam of DKH Institut, I confirm that I have understood the terms of this consent and voluntarily agree to them.
